Lifty — Terms of Use
Effective date: [DATE] Version: 0.1 (draft)
These Terms of Use ("Terms") apply to the Lifty mobile apps for iPhone, Apple Watch, Android and Wear OS, and to the Lifty website (together, "Lifty"). Please read section 3 ("Safety") in full before you use Lifty on the mountain. It is the most important part of these Terms.
1. Who we are
Lifty is a free, non-commercial project made by an individual developer:
- [YOUR FULL LEGAL NAME]
- [Postal address], Barcelona, Spain
- Email: hello@lifty.ski
In these Terms, "we", "us" and "our" mean that developer. "You" means the person using Lifty.
2. Accepting these Terms, and who can use Lifty
By downloading or using Lifty you agree to these Terms. If you do not agree, do not use Lifty.
Lifty is free and is offered in the European Union. You do not need an account to use it.
You may use Lifty at any age, but you must be at least 14 (or the minimum age for consenting to online services in your country, if higher) to create an account, back up your ski days, share ride data, or turn on usage analytics. If you are younger, a parent or guardian must agree on your behalf.
How we handle your personal data is explained in our Privacy Policy. It is a separate document and is not part of these Terms.
3. Safety — what Lifty is, and what it is not
Skiing and snowboarding are dangerous. They can cause serious injury or death. Lifty does not change that, and does not make those activities safer.
3.1 Lifty is a planning aid, not a guide
Lifty suggests routes made of pistes and lifts, shows forecasts and conditions, and records your ski days. It is a convenience. It is not a substitute for your own judgement, for the resort's signs, or for instructions from resort staff.
On the mountain, always follow, in this order:
- instructions from ski patrol, lift staff and other resort personnel;
- signs, barriers, closure ropes, flags and markings on the ground;
- the resort's official piste map and its published opening status;
- the FIS Rules of Conduct for skiers and snowboarders (in particular: adapt your speed and route to your ability, the terrain, the snow, the weather and the traffic; respect all signs and markings).
If Lifty says something different from any of these, ignore Lifty.
3.2 The information in Lifty can be wrong or out of date
Lifty is built from open map data (OpenStreetMap and OpenSkiMap), information published by ski resorts, weather models and reports from riders. All of these can contain errors. In particular:
- Pistes and lifts may be missing, misplaced, renamed or wrongly connected. Resorts change their layout; the map may not have caught up.
- Difficulty grades are the resort's or the map's classification, not a guarantee. The same grade can mean different things at different resorts, and a piste's real difficulty changes with snow, ice, visibility, grooming and crowds. A route "filtered to blue" can still contain sections that are hard for you.
- Opening status may be stale. Lifty downloads data and then works offline. Lifts and pistes can close at any time — for avalanche control, wind, grooming, events, accidents or the end of the day — and Lifty may not know. Lift waiting times are estimates, not measurements.
- Routes may be impossible or unsafe. A suggested route may cross a closed piste, rely on a lift that has stopped, or arrive after the last lift. Always check the time and plan a way back.
- Forecasts and conditions are estimates. Weather, snow and "conditions" scores come from computer weather models (including data from Open-Meteo) and our own calculations. Mountain weather can change quickly and locally. The forecast for a resort is not the weather where you are standing.
- Avalanche information is shown for information only. It comes from official avalanche services, may be out of date, and never affects routing. Lifty does not route off-piste and must never be used to plan off-piste, touring or backcountry travel.
- Webcam images come from third parties and may be old or show a different place than described.
3.3 Your phone and watch can fail
GPS can be inaccurate in steep terrain, in forests and near lift towers. Batteries drain much faster in the cold. Phones and watches can crash, lose signal or break. Do not rely on Lifty as your only way to find your way around or back down. Carry the resort's paper map, know the last lift times, and keep enough battery to call for help.
3.4 Lifty is not an emergency device
Lifty does not contact emergency services, ski patrol or anyone else. It does not share your location for rescue. It is not an avalanche transceiver or locator beacon. In an emergency call 112 (or the local emergency number), or contact ski patrol.
Lifty does not pay, and is not responsible for, any search, rescue, evacuation or medical costs. Check that your insurance covers winter sports.
3.5 Don't use your phone while moving
Stop in a safe place, out of the way of other skiers, before you look at Lifty. Use the audio and watch prompts rather than looking at a screen while skiing. Do not operate Lifty while riding a lift in a way that endangers you or others.
3.6 Fitness and heart rate
Heart-rate and effort figures are for interest only. Lifty is not a medical device, and nothing in it is medical advice.
4. Using Lifty
4.1 Your licence
We give you a personal, non-exclusive, non-transferable, revocable licence to use Lifty for your own non-commercial purposes, under these Terms and the rules of the app store you downloaded it from.
4.2 What you must not do
You must not:
- copy, modify, resell or redistribute the Lifty apps, or reverse-engineer them, except where the law allows it;
- scrape, overload or interfere with our servers, or try to get around rate limits or security measures;
- submit false, abusive, unlawful or misleading reports or data, or try to manipulate the map, timings or crowd information;
- include other people's personal data (names, phone numbers, photos of people, licence plates) in reports or feedback;
- use Lifty for any unlawful purpose.
4.3 Changes and availability
Lifty is under active development. We may add, change or remove features, resorts or data at any time, and we may suspend or stop Lifty. We will try to give reasonable notice of a significant change that affects you negatively, and we will keep providing updates needed to keep Lifty working as described for as long as we offer it, as the law requires.
Lifty depends on downloads from the internet. We do not guarantee that Lifty, its servers or its data will always be available, complete or error-free.
4.4 Crash reports
To keep Lifty working, the app sends a crash report when it crashes. Crash reports are on by default. They say where in the code the problem happened and on which device model and operating system, under a random ID. They never contain your location, your ski days or your account. You can switch them off at any time in Settings → Privacy. Details are in the Privacy Policy.
5. Accounts (optional)
You can use Lifty without an account. If you create one (with Apple, Google or an email address):
- you are responsible for keeping your sign-in details secure and for activity on your account;
- you can delete your account at any time in Settings → Account. Deleting your account deletes your backups from our servers. It does not delete ski days stored on your phone;
- we may suspend or delete an account that breaks these Terms, after telling you why where we reasonably can.
Badges and entitlements (for example "Founding member") are free, have no monetary value, cannot be transferred or exchanged, and may be changed or withdrawn.
6. Your content
"Your content" means reports, feedback, notes, trip names and anything else you type into Lifty, photos you add to a place, and the ride data you choose to share or back up.
- You keep ownership of your content.
- Reports and feedback: you give us a free, worldwide, perpetual, irrevocable licence to use, copy, modify and publish the information in them (for example, to correct the map) in any form, including in open data. We never publish your own words or your email address.
- Shared ride data and map improvement: if you turn on ride-stats or map-gap sharing, or allow map improvement from your backups, you give us the same licence for the aggregated, anonymous results. Once data has been combined into anonymous statistics it cannot be taken out again.
- Photos you add to a place (needs an account): you confirm that you took the photo yourself and that it shows no one who could be recognised without their agreement. You give us a free, worldwide, non-exclusive, perpetual licence to store, resize, show and distribute it in Lifty and on lifty.ski, credited as a rider photo, without your name. Every photo is checked by us before it appears, and we may decline or later remove any photo without giving a reason. If you want an approved photo taken down, write to hello@lifty.ski. Photo terms version: 2026-10-19.
- Backups: we store and process your backup only to provide the backup service and, if you allow it, to improve the map, as described in the Privacy Policy.
- You confirm that you have the right to submit your content and that it does not break the law or anyone else's rights.
We may remove or ignore any report or content without giving a reason. Reports are not published in the app; they go to us for review. Photos are published in the app only after we approve them.
7. Third-party data and services
Lifty uses data and services from others. Their terms may also apply to you.
- Map data © OpenStreetMap contributors and OpenSkiMap, available under the Open Database License (ODbL). The routing data we derive from it is also made available under the ODbL at [URL].
- Base map © Mapbox, © OpenStreetMap contributors. Mapbox Terms.
- Weather data by Open-Meteo.com, licensed under CC BY 4.0.
- Avalanche bulletins, lift status and webcams are published by the respective avalanche services, resorts and webcam providers, and remain theirs.
- Apple Health, Health Connect, Sign in with Apple, Google Sign-In, Strava and Slopes are services of their providers. Lifty only reads from them what you allow, and only when you ask.
We are not responsible for third-party data or services, or for their availability. A full list of credits is in the app under Settings → About → Acknowledgements.
8. Our intellectual property
The Lifty apps, name, logo, design and our own content belong to us or our licensors. Data that comes from open sources stays under its own licence (section 7); nothing in these Terms limits your rights under those licences.
9. Our liability
9.1 What we never limit
Nothing in these Terms limits or excludes our liability:
- for death or personal injury caused by our negligence;
- for fraud, wilful misconduct or gross negligence;
- under product liability law; or
- for anything else that cannot be limited or excluded by law, including your statutory rights as a consumer.
9.2 Within those limits
Subject to section 9.1:
- Lifty is free, and we provide it as described in these Terms. We do not promise that it will meet every need or be free of errors.
- We are not liable for loss or harm that results from your own failure to follow section 3 (Safety) — for example, from ignoring signs, closures or resort staff, from skiing beyond your ability, or from relying on Lifty instead of your own judgement.
- We are not liable for loss caused by events outside our reasonable control, including failures of your device, its battery or GPS, mobile networks, app stores or third-party services.
- We are not liable for indirect or unforeseeable loss.
- For other loss caused by our ordinary (slight) negligence, our total liability is limited to €[100].
We recommend that you back up your ski days. Where we are responsible for lost data, we are only responsible for what it would have cost to restore it from a reasonable backup.
10. Your rights as a consumer
If you are a consumer, you have legal rights that these Terms do not affect, including the right to digital content that conforms to its description and to updates needed to keep it conforming. If you think Lifty does not work as described, contact us at hello@lifty.ski and we will try to fix it.
11. Ending these Terms
You can stop using Lifty at any time by deleting the app (and your account, if you have one).
We may stop providing Lifty to you, or end these Terms, if you seriously or repeatedly break them, or if we stop offering Lifty. Sections 6, 8, 9 and 13 continue to apply after these Terms end.
12. Changes to these Terms
We may update these Terms, for example when we add features or when the law changes. We will show the date of the latest version at the top. If a change materially affects you, we will tell you in the app before it takes effect. If you don't agree with the new Terms, you can stop using Lifty and delete your account.
13. Law and disputes
These Terms are governed by Spanish law. If you are a consumer living elsewhere in the EU (or in another country whose law protects you), you also keep the protection of the mandatory rules of the country where you live, and you can bring a claim in the courts there or in Spain.
Please contact us first at hello@lifty.ski — most problems can be solved quickly. You can also use the consumer arbitration system (Sistema Arbitral de Consumo) or your local consumer authority.
If any part of these Terms is found invalid, the rest stays in force.
14. App Store and Google Play
If you downloaded Lifty from Apple's App Store:
- these Terms are between you and us, not Apple. Apple is not responsible for Lifty or its content;
- Apple has no obligation to provide maintenance or support for Lifty;
- if Lifty fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any — Lifty is free). To the maximum extent permitted by law, Apple has no other warranty obligation for Lifty;
- Apple is not responsible for any claims by you or a third party relating to Lifty, including product liability claims, claims that Lifty fails to meet legal or regulatory requirements, and consumer protection or privacy claims;
- if a third party claims that Lifty infringes its intellectual property rights, we, not Apple, are responsible for dealing with that claim;
- you confirm that you are not located in a country subject to a US Government embargo or designated as "terrorist-supporting", and that you are not on any US Government list of prohibited or restricted parties;
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If you downloaded Lifty from Google Play, Google Play's terms also apply between you and Google.
